** This contract is a "living document."  It is designed first and foremost to protect the puppy longterm as well as protecting both the breeder and buyer.  However, individual contracts may vary.  We are always willing to work with individual buyers on specific issues, please do not be afraid to ask any questons, for clarification, or changes needed.

Sale of the above-described puppy is made subject to the following terms and conditions:

Deposits are Non refundable unless we are unable to make delivery on your puppy. 

Breeder guarantees the health of this puppy at the time of sale. Buyer is to take the puppy to a veterinarian within 24 hours for a get-acquainted visit and checkup. Breeder is not responsible for well visit costs incurred after transfer of puppy. Breeder is not responsible for death or injury to the puppy upon transfer to buyer.  The buyer understands that if he/she is taking possesion of this puppy earlier than the reccomended ten week observation period, the breeder cannot be held responsible death or illness of any kind including that of a genetic nature. 

Should the buyer be unable to keep this dog at any time, buyer will return the dog to the breeder.  A partial refund may be given if the dog can be resold less the cost of boarding, all refunds are to be determined by the breeder only.   This dog is not to be resold or given to any other party without express written permission of the breeder. Under no circumstances is this dog to be surrendered to an animal shelter or rescue organization. The breeder is always available as a safety net for the lifetime of every puppy we sell, no matter what the circumstances are or how old the "puppy" may be.

Puppies are sold at a special pet price and are NOT to be used for breeding to add more puppies to the surplus dog population, unless sold as a breeder. Puppies are to be spayed or neutered within 6 months of transfere.  Registration papers will be issued after documentation from a veternaian is provided. Buyer agrees to spay or neuter this puppy at the earliest appropriate age as determined by buyers veterinarian.  However, we do strongly suggest this is done by 6 months of age.

 Breeder makes no warranty as to size, features, color, or any other characteristics of puppy when fully matured.  Puppy is transferred as pet quality unless otherwise stated in this agreement. This agreement is the only expressed or implied warranty given with the above puppy and all aspects of the transfer are final unless otherwise stated above.

The above described puppy must be paid for in full at the time of transfere via paypal, check, money order or cash.  Checks must clear our bank prior to transfere of puppy.  After week 15,  unless othewise agreed upon in this contract, the buyer incurs a charge of  $10.00 per day (our kennel boarding rate) each day the puppy remains in the kennel due to an unpaid balance.  After week 15, the buyer forfiets the deposit amount of $250.00 plus 10.00 per day boarding fee and the puppy will be considered the sole property of the kennel.   All moneys paid beyond 250.00 plus the daily kennel rate of 10.00 per day will be refunded. 

       This puppy is gauranteed against GENETIC DEFECTS .  Defects must be determinded by age 2.   Buyer must consult with Breeder within 24 hours of any illness / death and follow advice of Blake Foskey of Foskey's Veterinarian clinic unless otherwise agreed upon by breeder. Under no circumstances is Seller to be held responsible for medical services. Buyer must have any autopsy if death has occured performed by the Foskey's Veterinarian clinic only within 24 hours of death to determine cause of death is due to a genetic issue.  Breeder agrees, if a genetic defect is found, to replace the puppy with the next availble puppy from her kennel only upon return of the puppy with proper proof from the breeder’s veterinarian and return of live puppy (either to breeder if alive or vet if death has occured.   No monitary refund will be given unless otherwise stated in this agreement.

       If any provision of this contract is or becomes void or unenforceable by force or operation of law, the other provisions shall remain valid and enforceable.  In the event of a dispute,  The State of Texas, County of Orange, will have jurisdiction over the matter.

      Definitions:

1.  A Genetic Defect is defined as any condition which is widely held by the veterinary profession to be hereditary in nature.   Exceptions are patellar luxation stage I and II(must not be a cause by trauma, click here for additional information), diet controlable PSS,or tracheal collapse.  Hypoglycemia is not considered a genetic defect and is avoidable with proper care.   

2.  A day is defined as the twelve hour period from 7:00 am to 7:00 pm,  15 days is defined as 105 days beginning the date of whelp.

      The entire and only agreement between the parties is contained herein.
